These Terms of Service (the "Terms") constitute a legally binding agreement between you (the "User" or "you") and eSIM Cover ("eSIM Cover," "we," "us," or "our"), concerning your access to and use of our website (esimcover.com), mobile applications, eSIM services, data plans, and related customer support (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

eSIM Cover provides prepaid eSIM (embedded Subscriber Identity Module) data plans that enable mobile data connectivity in various countries and regions worldwide. Our Service includes the sale and digital delivery of eSIM profiles (via QR code, activation code, or one-tap installation), related customer support, and account management.
eSIM Cover partners with mobile network operators and telecommunications providers in each destination country. Network services are provided by these third-party partners, and coverage, speeds, and availability may vary by location.

4.1 Purchase: By completing a purchase on our platform, you agree to pay all applicable charges for the selected data plan. All prices are displayed in USD (United States Dollars) unless otherwise stated. Applicable taxes, where required by law, will be added at checkout based on your billing location.
4.2 Delivery: Upon successful payment, eSIM activation details (QR code, activation code, and/or installation link) will be delivered to the email address you provided. Delivery is typically instant but may take up to 15 minutes. Ensure you have a stable internet connection to receive and install your eSIM.
4.3 Activation: Data plan validity commences upon first connection to a supported network at your destination. Some plans activate upon installation—refer to the specific product details provided at purchase. Expired or fully consumed plans cannot be reactivated.
4.4 eSIM Retention: We recommend keeping the eSIM on your device until the data plan is fully consumed or expired. Removing the eSIM before the validity period ends may result in loss of service and does not entitle you to a refund.
5.1 Plan Types: eSIM Cover offers both fixed data and unlimited data plans. Plan details—including data allowance, validity period, coverage countries, and any applicable speed or usage policies—are displayed on the product page at the time of purchase.
5.2 Unlimited Data Plans: "Unlimited" plans are subject to a Fair Usage Policy (FUP) imposed by our network partners. To ensure quality of service for all users, network operators reserve the right to reduce data speeds or restrict high-bandwidth activities after a specified daily or total usage threshold. The applicable threshold, if any, is disclosed on the product page. This is standard practice across all mobile network operators globally.
5.3 Plan Changes: Once a data plan is activated, you cannot downgrade, upgrade, or transfer the plan to another device or user. Data allowances cannot be "topped up" mid-plan—a new eSIM purchase is required.
All eSIM data plans are prepaid. Payment is processed at the time of purchase through our authorized payment processors (including Stripe, PayPal, Klarna, WeChat Pay, and other listed providers). By submitting payment information, you authorize us (or our payment processors) to charge the total amount displayed at checkout.
You represent and warrant that you have the legal right to use any payment method you provide. In the event of a chargeback or payment dispute, we reserve the right to suspend your account and access to the Service pending resolution.
7.1 We take commercially reasonable steps to ensure Service availability. However, eSIM Cover does not guarantee continuous, uninterrupted, or error-free network connectivity. Service quality depends on our network partners' infrastructure, which is beyond our direct control.

All content on the eSIM Cover platform—including but not limited to text, graphics, logos, icons, images, audio clips, software, and data compilations—is the exclusive property of eSIM Cover or its licensors and is protected by copyright, trademark, and other intellectual property laws. The "eSIM Cover" name and logo are trademarks of eSIM Cover. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our content without prior written permission.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, eSIM COVER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. eSIM COVER DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
12.1 TO THE FULLEST EXTENT PERMITTED BY LAW, eSIM COVER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
12.2 eSIM Cover's total aggregate liability arising from or relating to these Terms or the Service shall not exceed the amount you paid to eSIM Cover for the specific data plan giving rise to the claim during the twelve (12) months preceding the event giving rise to liability.
12.3 Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
If you purchase an eSIM through one of our authorized resellers or partners ("Third-Party Sellers"), your purchase agreement is with that Third-Party Seller, and their terms and conditions may also apply. eSIM Cover's responsibility is limited to providing the eSIM and data plan as described at the point of sale. Refund requests for purchases made through Third-Party Sellers must be directed to the seller from whom you purchased.
14.1 By You: You may terminate these Terms at any time by ceasing use of the Service and closing your account. Termination does not entitle you to any refund for previously purchased and activated data plans.
14.2 By Us: eSIM Cover may suspend or terminate your account and access to the Service, with or without notice, for any violation of these Terms, any fraudulent or illegal activity, or any conduct that we determine, in our sole discretion, to be harmful to eSIM Cover, our users, or our network partners.
14.3 Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) shall survive.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on our website and updating the "Last Updated" date. For material changes affecting your rights, we will provide notice via email where reasonably possible. Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the English language. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.
For users in the European Union, nothing in this section shall deprive you of the protection afforded to you by the mandatory provisions of the laws of your country of residence.
